Rocktime provides the email marketing software application ' EPrecision' under a licence agreement with authorised clients. EPrecision allows the client and its authorised users to send emails to multiple recipients. Rocktime provides a 'hosting' platform in order to facilitate this function.
Rocktime supports the use of email marketing as a defined business sales & marketing channel. However Rocktime explicitly does not provide the EPrecision service for the purpose of sending 'Unsolicited Email' also known as 'Spam'. Email Marketing and Spam is governed in the UK, and overseas, and all EPrecision clients must fully abide by such regulations when utilising EPrecision for the purpose of email marketing.
In particular Rocktime would point out one of the governing protocols concerning a complete 'Opt-In' Policy; this includes clients contacting their existing customers by email marketing means.
Rocktime will take any report of their client’s using EPrecision for the purpose of Spam extremely seriously. It is a violation of the Rocktime EPrecision agreement to send unsolicited emails with any EPrecision product.
In the majority of cases sending Unsolicited Email/ SPAM will be in violation of the applicable laws. In such cases EPrecision clients will be solely responsible and liable for associated damages and infringements. Rocktime reserve the right to permanently withdraw all hosting platforms that have facilitated the client in sending such Unsolicited Email. In addition Rocktime may refuse technical support and all other EPrecision services in respect of an offending client. In such cases we will refuse any form of refunds, deny any product upgrades and may well pursue legal action and report the client's behaviour to anti-spam agencies.
All emails sent by Rocktime clients' utilising EPrecision must be identified as being sent to customers or prospects who have agreed to'Opt in'. When gathering fresh email addresses from customers or prospects the client must first be offered an 'Opt In'/ 'Opt Out' choice. This applies to all communication mediums such as online forms, print, telephone etc. Clients who purchase/ lease email addresses (data lists) for the purpose of email marketing must ensure that such email addresses are all 'Opt In'. If requested Rocktime will require proof of the 'Opt In' veracity of such lists.
All 'Opt Out' requests must be honoured by the client without exception and without delay. EPrecision allows its clients to apply easy to use ‘Unsubscribe links’ on all email marketing activities conducted; such links must be applied to all email marketing activities at all times. In addition and where applicable EPrecision will provide an 'Unsubscribe tick box' to the client’s online ‘categories’ page and this must remain at all times.
All Rocktime EPrecision clients are fully responsible for the entire content of emails they send out, this extends to text and imagery. The client should be assured that all such content is not in anyway illegal, misleading or false.
Reporting Suspected Spam / Unsolicited Emails
Rocktime takes the issue of Spam very seriously. If you have received an email that you believe originated from an EPrecision product please first ensure that you are not already subscribed to receive such emails. You may also wish to check that the company you have received the email from is not one with whom you have an existing relationship.
